Under Section 10(13A) of the Income Tax Act, salaried individuals who live in rented accommodation can claim a tax exemption on their House Rent Allowance (HRA). This significantly reduces taxable gross income under the Old Tax Regime.

What is HRA Tax Exemption?

If you receive HRA from your employer and pay rent for your residential quarters, you can claim a deduction. Note that the exemption is only applicable if you pay rent—living in your own house or not paying rent makes the entire HRA component fully taxable.

The Three Core HRA Rules

The exempt HRA amount is calculated as the minimum of the following three parameters:

  1. Actual HRA: The total HRA component received from your employer.
  2. Excess Rent Paid: Total rent paid minus 10% of your Basic salary + DA.
  3. Salary Percentage: 50% of Basic salary + DA (if living in Delhi, Mumbai, Kolkata, or Chennai) or 40% (for non-metro cities).

Metro vs Non-Metro Difference

Only Mumbai, Delhi, Kolkata, and Chennai qualify for the 50% limit under income tax guidelines. All other highly populated cities (like Bengaluru, Hyderabad, and Pune) are evaluated under the 40% non-metro tier for HRA purposes.

To claim this deduction through corporate payroll, you must submit:

  • Rent Agreement: Valid, signed residential lease.
  • Rent Receipts: Signed monthly receipts from the landlord.
  • Landlord's PAN: Mandatory if annual rent paid exceeds ₹1,00,000.
